(Hereinafter the "Seller".)
BUYER
The natural or legal person purchasing through the Globy app and/or website. (Hereinafter the "Buyer".)
2. Subject
This contract governs the rights and obligations of the parties regarding the sale, delivery and use of the eSIM data packages ordered electronically by the Buyer through the Globy app and/or website. It is drawn up under the Turkish Consumer Protection Law No. 6502 and the Regulation on Distance Contracts. The Buyer acknowledges the opportunity to review and approve this contract electronically before completing the order.
3. Description of the Service
The Seller sells digital eSIM data packages usable in various countries and regions. The products are digital content requiring no physical delivery. The coverage region, data amount, validity, total price, supported countries and networks are shown to the Buyer before purchase.
4. Network & Telecom Infrastructure
The Seller is not a mobile network operator or telecom carrier. The eSIM packages run on infrastructure provided by third-party telecom providers and international network operators. Coverage, connection quality, speed, roaming, signal strength and availability depend on those operators' infrastructure and local conditions. The Seller is not liable for outages, slowdowns or coverage gaps arising from third-party operators, but commits to reasonable technical support.
5. Order, Payment & Invoicing
The Buyer places the order after reviewing the product's features and total price. The order requires successful payment. Payments are processed via licensed, secure payment service providers; the Seller does not store card details. After successful payment, an e-invoice / e-archive invoice is delivered electronically in accordance with the legislation.
6. Delivery
The eSIM package is delivered electronically after payment is completed — shown within the Globy app, by providing eSIM installation details and, where needed, a QR code. There is no physical shipment. Except for technical load or third-party delays, delivery typically completes within a few minutes.
7. Device Compatibility
Before purchase, the Buyer is responsible for verifying that their device supports eSIM, is carrier-unlocked, and supports the purchased package. The Seller is not responsible for the service being unusable due to device incompatibility, carrier lock, incorrect installation, wrong device settings or other Buyer-side technical causes.
8. Right of Withdrawal & Refunds
8.1. Withdrawal exception. The service is digital content performed instantly in electronic form, within the scope of Article 15/1(ğ) of the Regulation on Distance Contracts. The Buyer accepts that they requested instant delivery and were informed that the right of withdrawal may be lost once performance begins.
8.2. Globy refund policy. Despite the absence of a legal right of withdrawal, the Seller may evaluate a refund for customer satisfaction if ALL of the following are met:
- the eSIM has never been activated,
- no data usage has occurred,
- no more than 180 days have passed since purchase.
If the eSIM is activated or data usage begins, the refund request may be rejected. Mandatory consumer rights under law are reserved.
9. Rights & Obligations
The Buyer agrees that the information provided is accurate and current, that they will use the service lawfully, and will not engage in fraud, chargeback abuse or activities harming third parties. The Seller undertakes to provide the purchased service, reasonable technical support, and to fulfil its obligations under applicable law.
10. Force Majeure
Events beyond the parties' reasonable control — natural disasters, war, terrorism, cyber-attacks, telecom infrastructure failures, internet outages, government decisions, regulatory actions and third-party operator outages — are deemed force majeure. The parties are not liable for non-performance during force majeure.
11. Protection of Personal Data
The Buyer's personal data is processed in accordance with the applicable KVKK, GDPR and related legislation. Detailed information is provided in the Privacy Policy published on Globy platforms.
12. Disputes
For disputes arising from this contract, the Consumer Arbitration Committees at the Buyer's place of residence or the place of transaction have jurisdiction within the monetary limits announced annually by the Turkish Ministry of Trade; above those limits, the Consumer Courts have jurisdiction.
13. Effect
The Buyer declares that they have read and approved this contract electronically, accepted its terms, and read and accepted the Privacy Policy. This contract enters into force upon the Buyer's electronic approval.
