GLOBY - Terms of Service

1) Introduction & Contract Parties
These Terms of Service ("Terms") are a binding agreement between Zace Tech OÜ, a company incorporated in Estonia (address: Ahtri tn 12, 15551 Tallinn, Estonia) operating under the brand name “Globy” ("Globy", "Company", "we", "us", "our") and you ("you", "your", "User"). By accessing or using the Globy website, mobile application (Globy eSIM), or any related features and services (together, the “Services”), you agree to be bound by these Terms.
If you do not agree, do not use the Services.

2) Description of Services
Globy enables users to explore, purchase, activate and manage prepaid mobile data plans delivered via embedded SIM (eSIM) technology. Globy does not provide voice calling or SMS services unless explicitly stated.
Your device must be eSIM-capable and carrier-unlocked. Service availability, speeds and coverage are provided by third-party networks and may vary by location and time.
Activation Trigger & Validity Start. Unless otherwise stated for a specific plan, the plan’s validity period (e.g., 7/15/30 days) starts at the earlier of (a) the moment the eSIM profile is activated on the device (installation + line enabled), or (b) the moment the device first attaches to a supported network in a covered country, whichever occurs first.

3) Supplier Relationship (Third‑Party Carriers)
Globy distributes eSIM data plans that are supplied by licensed telecommunications providers and/or aggregators (collectively, “Suppliers”). Globy acts as an authorized reseller/technical intermediary and does not own or operate the underlying networks. Your connectivity depends on Supplier infrastructure. To the maximum extent permitted by law, Suppliers are responsible for network delivery and maintenance of their plans, and Globy disclaims liability for Supplier performance.
Fair Usage & Network Management. Certain plans may be subject to the applicable Supplier’s fair usage policies (FUP), traffic management, throttling, or prioritization rules. These measures are outside Globy’s control and may affect speeds and service quality.

4) Eligibility & Accounts
The Service is intended for general audiences. Accounts must be created by individuals aged 18 or older. Minors may only use the Service under the supervision of a parent or legal guardian who is the account holder. You must provide accurate information and keep it updated. You are responsible for safeguarding your login credentials and for all activity under your account.

5) Prohibited Uses
You agree not to:
• engage in fraud, chargeback abuse, payment manipulation, or resale of plans/credits;
• attempt to access, probe, or test the Service or networks without authorization;
• reverse engineer, scrape, or harvest data;
• share, clone or otherwise misuse eSIM profiles in violation of Supplier or device rules;
• use the Service in violation of applicable telecommunications, export control, or sanctions laws.
Enforcement: In case of fraud, manipulation, or unauthorized access attempts related to payments, eSIM plans, or Globy Credits, Globy may, at its sole discretion, permanently suspend your account and cancel any active eSIM plans or credits associated with the account.

6) Purchases, Pricing & Payments
Payments are processed securely via Stripe, which also supports Apple Pay, Google Pay, PayPal, and major credit/debit cards where available. Prices, taxes and plan availability may vary by region and are shown before purchase. You authorize Globy/Stripe to charge your selected method for all amounts due.
Installation Deadline. Unless otherwise specified for a plan, you must install/activate your purchased eSIM within 180 days from the purchase date. After this period, Suppliers may void or reconfigure profiles, and Globy may be unable to reissue the plan.

7) Globy Credits
Globy may offer a virtual balance (“Globy Credits”) usable for eligible purchases in the app.
• Non‑cash: Credits cannot be redeemed for cash and cannot be transferred to other accounts or platforms.
• No Expiry: Unless stated otherwise in a specific promotion, Globy Credits do not expire.
• Refunds: Credits purchased are non‑refundable. If you buy a plan with Credits and do not activate (i.e., no data usage) you may request a reversal; any approved refund is made back to Credits.

8) Refunds & Cancellations (summary; see Purchase Policy)
If you purchase an eSIM plan and do not activate/use any data, you may request a refund within 180 days from the purchase date. After 180 days, refunds are not available unless required by law.
Right of Withdrawal for Digital Content. By requesting immediate delivery of an eSIM profile, you acknowledge and consent that performance begins immediately, and you lose the statutory 14‑day withdrawal right once activation or any data usage occurs (EU digital content rules). This does not affect Globy’s voluntary 180‑day refund policy for unused/unactivated plans.

9) Installation, Activation & Usage
After purchase, follow the on‑screen steps to download and install the eSIM profile. A stable internet connection is required. The eSIM profile may remain on your device after the plan expires; you may remove it via device settings. You are responsible for ensuring device compatibility and for activation; Globy is not responsible for activation failures arising from device lock, unsupported models, or incorrect settings.

10) Service Changes & Availability
We may modify, suspend, or discontinue any part of the Services at any time. We may introduce updates or new features. Network availability and quality can vary due to Supplier‑side conditions, maintenance, or congestion. Service is provided on a reasonable‑efforts basis; no minimum quality levels are guaranteed.

11) Intellectual Property
All trademarks (including Globy), Service content, software and materials are owned by or licensed to Globy and protected by law. You receive a limited, non‑exclusive, non‑transferable license to use the Services for personal, non‑commercial purposes.

12) Privacy
Your personal data is processed in accordance with our Privacy Policy, which forms part of these Terms. By using the Service, you consent to such processing.

13) Disclaimers
The Services are provided on an “as is” and “as available” basis. To the fullest extent permitted by law, Globy disclaims all warranties (express or implied), including merchantability, fitness for a particular purpose, accuracy, and non‑infringement. We do not guarantee uninterrupted or error‑free service.

14) Limitation of Liability
To the maximum extent permitted by law, Globy shall not be liable for any indirect, incidental, special, punitive, or consequential damages (including lost profits or data). Our total aggregate liability for any claim arising out of or related to the Services shall not exceed the greater of (a) amounts you paid to Globy in the 1 month preceding the claim; or (b) €50.

15) Indemnity
You agree to defend, indemnify and hold harmless Globy, its officers, employees and Suppliers from and against claims arising from your use of the Services, violation of these Terms, or infringement of third‑party rights.

16) Governing Law & Jurisdiction
These Terms are governed by the laws of Estonia. Courts of Tallinn, Estonia shall have exclusive jurisdiction over disputes, subject to mandatory consumer protection laws of your residence. As an alternative dispute resolution option, the parties may agree in writing to mediation or arbitration.

17) Changes to Terms
We may update these Terms from time to time. The latest version will be posted in the app/site, with the effective date updated. Continued use constitutes acceptance.
